All use of the website http://www.marinejobboard.co.uk (‘the Website’) and signing up to our chargeable services (‘Services’) from us are subject to the terms and conditions below.

If you do not agree to these conditions cease use of the Website immediately. You may print and keep a copy of these terms. They are a legal agreement between us and can only be modified with our consent. We reserve the right to change the terms at our discretion by changing them on the website.

2. Accuracy of Information and Disclaimer
Marine Jobboard Limited (‘we’) will do its best to ensure all information on the Website is accurate.
If you find any inaccurate information on the Website let us know and we will correct it, where we agree, as soon as practicable.

You should ensure information you upload or send to us is accurate and does not breach national law or anyone’s rights such as copyright or is libellous, or is discriminatory in terms of age, race, disability, gender, religion or sexual preferences or obscene, menacing, threatening, offensive, abusive, fraudulent, criminal or infringes the rights of other people or in is in any way illegal. Remember that the Website can be viewed around the world and the information you send to us will be published on the Website.

All rights reserved to Marine Jobboard Limited. Materials may not be reproduced, copied, edited, published, transmitted or uploaded in any way without Marine Jobboard Limited‘s written permission.
Except as expressly stated in the limited licence provisions in this Agreement, Marine Jobboard Limited does not grant any express or implied right to you under any of its trade marks, copyrights or other intellectual property or proprietary information.

You waive your moral rights to be identified as author of the Advertisement and let us modify the Advertisement. It may, for example, be necessary to shorten advertisements or cut them to fit the Website.

If there are any restrictions as to the use to which we can put the Advertisements we must be told in advance and we may have to reject it. We reserve the right to reject any Advertisements at our discretion.

All Advertisements received will be assumed to be for publication on the Website and any further use, at its discretion, of Marine Jobboard Limited on an exclusive, royalty free, perpetual basis.

The Website contains copyright material, trade names and other proprietary information, including, but not limited to, text, photos, graphics and may in future include video, graphics, music and sound.

The entire contents of the Website are protected by copyright law. We, or our licensors own copyright and/or database right in the selection, co-ordination, arrangement and enhancement of such content, as well as in the content original to it. You may not modify, publish, transmit, participate in the transfer or sale, create derivative works, or in any way exploit, any of the content, in whole or in part except as provided in these Terms. You may download information from the Website for your own personal use only. Except as otherwise expressly permitted under copyright law, no copying, redistribution, retransmission, publication or commercial exploitation of downloaded material will be permitted without our express permission and that of the copyright owner.

In the event of any permitted copying, redistribution or publication of copyright material, no changes in or deletion of author attribution, trade marks or copyright notice shall be made. You acknowledge that you do not acquire any ownership rights by downloading copyright material.

4. Job Boards
We encourage users of the Website to contribute to our boards. You must follow our Board Rules and use is only authorised on that basis.

All accepted Advertisements on the Jobs Board are to be available for viewing on the Website for 14 days from the date of acceptance, unless stipulated by either party prior to the Advertisement being displayed on the Website.

When an Advertisement is purchased we agree to provide up to 12 months before we treat the purchased Advertisement as expired.

You are not required to make use of your Advertisement immediately upon purchase. We agree to provide you with posting space for your Advertisement on a credit basis which will remain open for 12 months from the date of purchase.

Please note that the upload of any company logo or trade mark on your account or Advertisement will attract a surcharge which will be subject to Payment (see clause 10) as a chargeable service.

If you see any information there which breaches your or anyone else’s rights or may be illegal, defamatory or otherwise should be removed, let us know immediately and, where we agree, we shall do our best to remove it as soon as possible. You agree to indemnify us for losses suffered as a result of a breach of these provisions or any other provisions of the terms or the Board Rules

We reserve the right to remove boards, listings and categories or edit them at our discretion, but have no obligation to do so.

5. Security
You are solely responsible in all respects for all use of and for protecting the confidentiality of any username, e-mail verification and password that may be given to you or selected by you for access to the service. You may not share these with or transfer them to any third parties. You must notify us immediately of any unauthorised use of them or any other breach of security regarding our website that comes to your attention.

6. Linked Websites
We make no representations whatsoever about any other websites which you may access through our Website. When you access any other website you understand that it is independent from us and that we have no control over the content or availability of that website. In addition, a link to any other website does not mean that we endorse or accept any responsibility for the content, or the use of, such a website and shall not be liable for any loss or damage caused or alleged to be caused by or in connection with use of or reliance on any content, goods or services available on or through any other web or resource. Any concerns regarding any external link should be directed to its website administrator or webmaster.

We provide most of the information on this Website free of any access charge. There is no charge for viewing the information provided on the Website. It is provided on the basis of no liability for the information given.
Where we provide Service to you or our users we accept liability for direct loss arising from not having used reasonable skill and care in the provision of such services up to the price you have paid us in any year, in the year of claim.

8. Barring from the Website
We reserve the right to bar users from the Website, on a permanent or temporary basis at our discretion. Any such user shall be notified and must not then attempt to use the Website under any other name or through any other user.

9. Chargeable Services
When you agree to take out a chargeable service with us, such as advertising, you enter into a contract with us to take such services.
All chargeable services and prices are clearly marked as chargeable on our Website or otherwise expressed in writing to you prior your acceptance.
We reserve the right to reject any order for services at our discretion without giving any reason to you. Our liability for our services is set out in paragraph 5 and otherwise in these terms.
The subscription of Material (see clause 12 for definition) from our Website, including the subscription of Curriculum Vitae, will be a chargeable service on our Website and subject to the cost offered at the time of purchase. We reserve the right to vary the cost of this subscription on our Website.
We reserve the right to vary our fees from time to time relating to the chargeable services. The current fees will be published on our website at the time of purchase.

10. Payment

  1. To accept and access our service via our website we require payment by credit / debit card, cheque or postal order in advance. Users purchasing advertising space or Advertisements (one or more) can make payment in advance which we agree to treat on a credit basis. The advertising space; once purchased and not used; will remain valid for a period of 12 months from the date of purchase.
  2. At the end of the agreed advertising period or on expiration of any unused advertising space your account will automatically expire rendering your Advertisement unavailable for management or viewable on the Website. Prior to your account expiring, we agree to provide you with an extension of 28 days which will constitute a chargeable service. You are entitled to allocate the 28 days to any Advertisement. You must be 18 years (or older if the age of majority is older in your country).
  3. In the event you purchase a chargeable service, not via our Website, we expect payment to be made in full within 14 days from the date of the invoice provided to you at the time of purchase. In this circumstance we agree that clause 10.1 would not apply.
  4. Please note that if you cancel any of our chargeable services, namely services relating to advertising you MUST first cancel the payment before cancelling the service. Failure to do so will result in your account continuing to be charged and there will be no right to a cancellation fee. 
  5. Marine Jobboard Limited is entitled to refuse any request for its chargeable service made placed by you. If your account is accepted, we will confirm acceptance to you by online electronic means (‘Confirmation’) to the e-mail address you have given us on registration.
  6. We reserve the right to obtain validation of your credit or debit card details before providing you with any service.
  7. We do not refund any fees relating to our services.

11.Termination
You may terminate a chargeable service on giving 1 months notice at any time.

12. Access to our Service
12.1 Subscription to http://www.marinejobboard.co.uk is free. Payment is required when you wish to advertise on our Website. When we accept your order we grant you a non-exclusive, non-transferable licence to use the services on our website. This licence to use our Services is granted on the terms and conditions of this Agreement. All advertising content, jobs Advertisement and user profiles, curriculum vitae uploaded to our Website will be referred to as ‘Material’.

12.2 In relation to the Services, please read the Acceptable Use Policy, but note that you are permitted to do the following:

12.2.1 You may:
(i) display Materials agreed by us electronically on our Website;

(ii) download and store one copy of the Materials readable form; and

(iii) print one copy of the Materials.

12.2.2 You may not:
(i) download, store, reproduce, transmit, display, copy, distribute or use Materials other than in   accordance with sub-clause 12.2.1 above;

(ii) sub-license, rent, lease, transfer or attempt to assign the rights in the Materials to any other person;

(iii) make the Materials available on any network;

(iv) use the Materials in any manner, or transfer or export the Materials or any copies into any country, other than in compliance with applicable laws; or

(v) allow any other person to use the Materials other than in accordance with the terms and conditions.

(vi) You accept that you are responsible for the confidentiality and use of your username and password, and agree not to transfer or re-sell your account to any third party. If you believe your account is no longer secure you must immediately change your password, which can be done in the ‘My Account’ section when logged in.

12.3 The Materials are presented solely for your private and commercial use, and may not be copied or re-sold.

12.4 We may terminate or suspend your use of the Service at any time if you are found in breach of any of these terms and conditions.

13.   Warranties and Returns
13.1 We warrant that:
                (a)  we have a right to display the Materials to you; and
                (b)  we will provide our services with reasonable skill and care.

13.2 If you have any complaints, you should direct them to us via e-mail we will respond within 72 hours.

13.3 You warrant that at all times you will comply with the Acceptable Use Policy that can be found on the website on entry to the service.

14. Modifications
We reserve the right to make changes or corrections, alter, suspend or discontinue any aspect of the Service, including your access to it. Unless explicitly stated to the contrary any new features will be subject to these terms and conditions. Please note that although we try to ensure that the content of our Website and/or the Service is accurate, our website and/or the Service may contain typographical errors or other inaccuracies.

Access to your photographs and to the forum sections of the website can be controlled by you. This will ensure anonymity. We advise you to set up your controls to ensure no one spam your e-mail address.

15.4 We do use cookies.
Please see our Privacy Policy on this. In short cookies are used to provide anonymous statistics on webtraffic to our website.

16. Legal Jurisdiction and Dispute Resolution
English law shall apply to these terms, notwithstanding the jurisdiction where you are based. You irrevocably agree that the courts of England shall have exclusive jurisdiction to settle any dispute which may arise out of, under, or in connection with these Terms and for those purposes irrevocably submit all disputes to the jurisdiction of the English courts. The place of performance shall be England.
We make no warranty or guarantee that the Website or information available over it complies with laws other than those of England.

17. General
Any formal legal notices should be sent to us at the address at the end of these Terms by by postal service.
Failure by us to enforce a right does not result in waiver of such right.
You may not assign or transfer your rights under this agreement.
Nothing in these Terms is intended to, nor shall it, confer any benefit on a third party whether under the Contracts (Rights of Third Parties) Act 1999 or otherwise.
We may amend these Terms at any time by posting a variation on the Website.
